By accessing or using ByeGrammar (“the Service”), you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

ByeGrammar is an AI-assisted language learning service that helps you improve your grammar and language skills through personalised feedback and learning resources.

3. Eligibility

You must be at least 16 years old to use the Service.

4. User Accounts

Each account is for your personal use only. You may not share, transfer, or allow others to access your account. You are responsible for all activity that occurs under your credentials, and for any information you submit through the Service. Please avoid submitting sensitive personal information.

5. Usage Limits & Plans

The Service may offer different access tiers. The features and limits available to you are defined by your current plan, which we may update from time to time.

6. Acceptable Use

You agree not to: • abuse, exploit, or circumvent the Service's usage limits or security controls; • reverse-engineer, decompile, attempt to extract the source code of, or infer the underlying algorithms, models, or methodologies of the Service; • copy, imitate, or create derivative works of any part of the Service, including its software, design, or brand; • use the Service or its outputs to develop or operate products that compete with us; • probe, scan, or exploit any vulnerability or security flaw; • access or use the Service in any manner not intended by its design; • submit unlawful, harmful, or abusive content; • use the Service in a manner that places an unreasonable or disproportionate burden on our infrastructure, including by consuming disproportionate amounts of storage or compute resources beyond normal personal use. You agree to indemnify and hold ByeGrammar harmless from any claims, losses, or damages arising from your use of the Service or your violation of these Terms.

7. Payments & Subscriptions

Paid subscriptions renew automatically until cancelled. By purchasing a subscription and accessing the Service immediately, you expressly request immediate performance and acknowledge that you will lose your right to cancel within 14 days. This does not affect your statutory rights. We may change our pricing or subscription plans from time to time. We will notify you of any such changes before they take effect. If you do not agree with any changes, you may cancel your subscription before your next renewal date. All fees are non-refundable except as required by applicable law.

8. Third-Party Services

The Service relies on third-party providers as described in our Privacy Policy. ByeGrammar is not responsible for the availability, accuracy, or actions of these services. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. AI Content Disclaimer

AI-generated content is provided for informational and learning purposes only. ByeGrammar makes no guarantee of correctness and accepts no responsibility for any actions taken based on AI-generated content. The Service should not be relied upon as professional, legal, academic, or examination advice. ByeGrammar makes no representation that AI-generated content is original or free from third-party intellectual property claims. You assume all risk associated with your use of such content.

10. Intellectual Property

You retain ownership of the content you submit and any directly derived versions of that content generated by the Service. You grant ByeGrammar a non-exclusive, royalty-free licence to use your content to operate, maintain, improve, and develop the Service and its learning systems. Where possible, we use this content in aggregated form or with personal identifiers removed. Analytical, educational, and instructional content generated or provided by the Service — including but not limited to error analyses, grammar explanations, and learning materials — separate from your submitted content and any directly derived versions of it, is owned by ByeGrammar. We grant you a personal, non-exclusive licence to use such content for your own learning purposes. You may not reproduce, distribute, or commercialise it without our permission. All other intellectual property in the Service — including its software, design, and brand — belongs to ByeGrammar. You may not copy, imitate, or create derivative works of any part of the Service without our prior written permission. Any feedback or suggestions you provide may be used by ByeGrammar without restriction or obligation to you.

11. Disclaimer of Warranties & Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind. ByeGrammar does not guarantee uninterrupted operation, error-free performance, or that your data will be free from loss, corruption, or unauthorised access. ByeGrammar is not liable for any failure or delay caused by circumstances beyond our reasonable control, including outages of third-party infrastructure or services. To the fullest extent permitted by law, ByeGrammar's total liability shall not exceed the fees you paid in the twelve months preceding the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

12. Termination and Service Changes

You may delete your account at any time. We may suspend or terminate your account at our discretion for any reasonable cause. Where termination results from a violation of these Terms, no refund will be issued. We may also terminate accounts without a paid subscription that have been inactive for an extended period; where possible, we will notify you by email before doing so. Upon termination, your access to the Service will cease and your content may be deleted without liability to you, subject to applicable law. We may also modify or discontinue features, or the Service as a whole, at any time. Where feasible, we will provide reasonable advance notice. Nothing in these Terms affects your statutory rights as a consumer.

13. Prohibition on AI Training

You may not use any content or output generated by the Service to develop, train, or improve any AI or machine learning model, including for the purpose of building competing services.

14. Claims Deadline

Any claim arising from your use of the Service must be brought within one year of the event giving rise to the claim.

15. Mobile Applications

If you access or use the Service via our iOS application, these Terms are between you and ByeGrammar only, and not with Apple Inc. Apple is not responsible for the Service or its content, has no obligation to provide maintenance or support, and shall have no liability for any claims relating to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any provision does not waive our right to do so in the future.

17. Governing Law

These Terms are governed by the laws of England and Wales.

18. Changes to These Terms

We may update these Terms at any time. Your continued use of the Service constitutes acceptance of the revised Terms.
